Chartwell Premium Funding Privacy Policy

In this Privacy Policy, “we”, “us”, and “our” means Chartwell Premium Funding Limited, Chartwell Premium Funding (Waikato) Limited, and Chartwell Premium Funding (Auckland) Limited (collectively, “Chartwell”).
We respect the privacy of your personal information. This Privacy Policy explains how we collect, store, use, and disclose your personal information in accordance with the Privacy Act 2020 and the Credit Reporting Privacy Code 2020 (where applicable).

• Insurance and financial information (such as policy details, insurer information, bank account details, transaction and repayment history)
• Contact information (such as name, phone number, email address, and physical address)
• Financial and billing information
• Any other personal information you provide to us

If you choose not to provide certain information, this may limit our ability to assess or provide premium funding services.
 
How We Collect Personal Information
We collect personal information:

• Directly from you (in person, by phone, email or in writing); and
• Indirectly from third parties (such as insurance brokers, financial advisers, or other intermediaries)

Where we collect personal information indirectly, we will take reasonable steps to notify you of:

• the fact that the information has been collected
• the purpose of collection
• the parties to whom the information may be disclosed
• our identity and contact details
• your rights of access and correction,

unless an exception under the Privacy Act 2020 applies.
We may also collect personal information where required or authorised by law, including under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009.
 
Purpose of Collection and Use
We collect and use personal information for the following purposes:

• assessing and managing insurance premium funding applications and agreements
• managing payments and accounts
• communicating with you about services
• complying with legal and regulatory obligations
• conducting audits and internal business administration.

 
We will only use personal information for purposes that are:

• set out in this Privacy Policy
• reasonably expected by you
• authorised by you, or
• required or permitted by law.

 
Disclosure of Personal Information
We may disclose your personal information where reasonably necessary for the purposes described in this Privacy Policy, including to the following categories of recipients:

• Service providers and professional advisers: including insurers, underwriters, loss adjusters, claims assessors, IT and cloud service providers, payment processors, document management providers, credit reporting agencies, auditors, legal advisers, accountants, compliance consultants, and other professional service providers engaged to support our business operations;
• Introducers and intermediaries: including insurance brokers (and specifically Affiliated Insurance Brokers), risk advisers, financial advisers, authorised representatives, and other intermediaries who arrange, administer, or assist with your insurance premium funding;
• Funding and financing parties: including current and prospective lenders, financiers, investors, warehouse providers, securitisation vehicles, special purpose vehicles (SPVs), trustees, trust managers, facility agents, security trustees, rating agencies, due diligence providers, and other entities involved in providing, supporting, or facilitating funding and financing arrangements to us;
• Securitisation and assignment counterparties: including parties to securitisation programs, receivables funding arrangements, or debt assignment transactions, who may acquire, review, or have security over interests in our loan book or receivables;
• Related entities: companies within the Chartwell group for internal administration, risk management, compliance, reporting, and operational support;
• Business partners: organisations with whom we have contractual arrangements or partnerships to deliver products or services;
• Transaction parties: any actual or prospective purchaser, transferee, assignee, investor, or other party involved in a proposed or actual sale, transfer, assignment, restructuring, refinancing, or other transaction involving our business or assets;
• Government, regulatory, and supervisory bodies: including New Zealand and overseas regulators, law enforcement agencies, courts, and supervisory authorities;
• Dispute resolution bodies: including external dispute resolution schemes and complaint authorities;
• Third parties authorised by you: including any person acting on your behalf such as your accountant, legal adviser, or financial adviser.

We will only disclose your personal information where it is reasonably necessary for the purposes described in this Privacy Policy, where you have authorised the disclosure, or where the disclosure is otherwise required or permitted by law.
 
Overseas Disclosure
We may disclose your personal information to third party service providers who may process your personal information either on our behalf or otherwise for one or more of the above-stated purposes.

Some of the third-party service providers to whom we disclose personal information are located in countries outside New Zealand, such as United Kingdom, Singapore, USA, Australia and India.  We will only disclose personal information overseas where permitted under the Privacy Act 2020, including where:

• the recipient is subject to comparable privacy laws; or
• appropriate safeguards are in place; or
• you have authorised the disclosure

 
Security of Personal Information
We take reasonable steps to protect personal information from:

• misuse
• interference
• loss
• unauthorised access, modification, or disclosure

Where required by law, we will notify you of any notifiable privacy breach.
 
Retention of Personal Information
We retain personal information only for as long as necessary to:

• fulfil the purposes for which it was collected; and
• meet legal and regulatory obligations (including AML/CFT requirements)

 
Updates of Privacy Policy
We reserve the right to amend our Privacy Policy from time to time to ensure we properly manage and process your personal data.
 
Access and Correction
You may request access to your personal information and request correction if it is inaccurate.
We will respond as soon as reasonably practicable and no later than 20 working days, unless permitted otherwise by law.
